Kiddonido – Provider Terms & Conditions

For providers, businesses and authorised representatives

These Provider Terms & Conditions govern the registration, claiming, management and publication of a provider or business profile on Kiddonido. They consolidate the provider-related provisions of Kiddonido's existing Terms of Use and add provider-specific safeguards concerning verification, child protection, content, images, personal data, legal compliance and platform governance.

1. About these Provider Terms

These Terms apply to every business, organisation, self-employed professional, academy, club, school, instructor or other provider that registers, claims, edits or manages a listing or activity on Kiddonido, and to every individual acting on its behalf.

By expressly accepting these Terms, the Provider enters into an electronic agreement with the operator of Kiddonido. Mandatory rights and obligations imposed by applicable law are not excluded or limited by these Terms.

2. About Kiddonido and the Platform

Kiddonido is a discovery and information platform that helps families find children's activities, classes, camps and related services and contact independent Providers.

Kiddonido does not currently organise, operate, staff or supervise Provider activities, does not currently take bookings for Provider activities, is not the merchant of record, and does not currently collect payment for Provider activities. Any arrangement, booking, payment, cancellation or refund agreed after an introduction through Kiddonido is directly between the Provider and the user unless Kiddonido expressly states otherwise for a future feature.

3. Eligibility, Authority and Provider Account

  • The person creating or managing the account must be an adult and authorised to act for the Provider.
  • The Provider must provide accurate business and representative information and promptly update material changes.
  • Login credentials must be kept confidential. The Provider is responsible for activity through its account, except where applicable law provides otherwise.
  • The Provider must promptly notify Kiddonido of suspected unauthorised access or loss of authority by an account administrator.

4. Registration, Claiming and Verification

A Provider may register a new business or claim an eligible existing listing. Registration or claiming does not create a right to publication or a verification label. Kiddonido may request information reasonably necessary to establish business identity and the claimant's authority.

An 'Unclaimed' listing means that the business has not taken over management of that listing. 'Business claimed' means Kiddonido has checked evidence that the claimant is authorised to manage the listing; it does not mean that Kiddonido has comprehensively verified the Provider, its staff, activity safety, legal compliance or service quality.

Where Kiddonido displays a 'Documents checked' or similar status, the status relates only to the categories of evidence actually reviewed and to the review date. It is not government approval, certification, a safety guarantee or an endorsement. Kiddonido may remove or pause a status when evidence expires, changes or becomes unreliable.

5. Information and Documents the Provider May Be Asked to Supply

Depending on the Provider type and activity, Kiddonido may request or review appropriate evidence. The exact evidence may differ by profession, activity, venue and legal requirements.

  • Business identity and registration details, tax/business identification and trading name where applicable.
  • Identity and authority of the person acting for the Provider.
  • Current professional or public liability insurance where applicable or required.
  • Licences, registrations, authorisations, venue permissions or activity permits where legally required.
  • Professional qualifications, federation credentials, teaching/coaching credentials or other legally required qualifications relevant to the listed activity.
  • Evidence relevant to safeguarding and lawful work with minors where applicable.
  • Any other evidence reasonably necessary to investigate a material safety, legal, authenticity or listing concern.

6. Provider's Continuing Legal and Operational Responsibilities

The Provider remains solely responsible for operating its business and activities lawfully. A Kiddonido review does not transfer that responsibility to Kiddonido.

  • Maintain all licences, registrations, qualifications, permissions and insurance required for its activities.
  • Comply with consumer, advertising, employment, tax, health and safety, accessibility, safeguarding, data-protection and other laws applicable to its services.
  • Maintain suitable premises, equipment, staffing, supervision, emergency arrangements and risk controls appropriate to the activity.
  • Notify Kiddonido promptly of a material change that affects the Provider's legal ability to provide a listed activity, the truth of a listing, or a verification status.
  • Provide updated evidence on reasonable request where a material document has expired or changed.

7. Safeguarding and Activities Involving Children

The Provider is responsible for its safeguarding practices and for determining and complying with all child-protection requirements applicable to its personnel and activities.

Where work involves habitual contact with minors, the Provider is responsible for ensuring that relevant employees, contractors and volunteers satisfy applicable Spanish child-protection requirements, including obtaining the legally required negative certification from the competent register where applicable.

The Provider must not rely on a Kiddonido listing, claim status or document review as a substitute for its own safeguarding checks, recruitment controls, supervision or statutory duties. A Provider declaration does not mean Kiddonido has independently verified every individual working for that Provider.

8. Accuracy of Listings

  • Listing information must be accurate, lawful and not misleading.
  • Material information such as prices, age ranges, schedules, dates, locations, languages, availability, accessibility information and contact details must be kept reasonably current.
  • Claims about qualifications, awards, safety, accreditation or special expertise must be supportable.
  • The Provider must correct material inaccuracies promptly after becoming aware of them.
  • Availability shown on Kiddonido is informational unless a future feature expressly confirms a booking.

9. Provider Content, Intellectual Property and Licence to Kiddonido

The Provider retains ownership of content it owns. By uploading or supplying listing text, logos, photographs, videos, testimonials or other material, the Provider grants Kiddonido a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, resize, translate and distribute that material on and in connection with the Kiddonido platform, including ordinary platform previews and promotion of the listing, for as long as the content is used on the platform.

The Provider warrants that it owns the content or has all permissions necessary to grant this licence and that the content does not infringe intellectual-property, privacy, publicity or other rights.

10. Images, Videos and Identifiable Children

The Provider confirms that it has the necessary rights and lawful basis to upload and authorise Kiddonido to publish every image, video, testimonial and other item it supplies, including appropriate permissions where identifiable children appear.

Permission to photograph a child, or permission to publish an image on the Provider's own website or social-media account, does not automatically mean the Provider has permission to authorise publication on Kiddonido. The Provider must ensure that the permission relied on covers the intended Kiddonido use.

The Provider must retain appropriate evidence of permissions relied upon, promptly notify Kiddonido of an objection or withdrawal affecting published material, and cooperate with removal where appropriate.

Use of an identifiable person's image in a separate advertising campaign outside the ordinary listing and normal platform previews may require separate authorisation. Nothing in this clause removes Kiddonido's own legal obligations.

11. Family Inquiries and Personal Data

When a family contacts a Provider through Kiddonido, the Provider may use the personal data received to answer and appropriately follow up that inquiry in accordance with applicable data-protection law.

The Provider must provide any privacy information it is legally required to provide as an independent recipient/controller of personal data. It must not add the person to unrelated marketing lists without a separate valid legal basis.

Sensitive or unnecessary information about a child should not be requested through general platform messaging. Where information concerning health, disability, dietary needs or other sensitive matters is genuinely necessary to deliver an activity, the Provider should collect and protect it through an appropriate lawful process.

12. Communications with Users

  • Respond honestly and professionally to inquiries.
  • Do not represent an inquiry as a confirmed booking unless the user and Provider have actually agreed one.
  • Clearly communicate the Provider's own prices, cancellation/refund terms and material participation conditions before a user commits.
  • Do not send spam or use Kiddonido inquiries for unrelated direct marketing without a lawful basis.

13. Prohibited Provider Conduct and Content

  • False, deceptive or materially misleading listings, prices, qualifications, availability or claims.
  • Impersonating another business or claiming a listing without authority.
  • Fake, incentivised or manipulated reviews, including reviewing the Provider's own business or a competitor.
  • Unlawful, defamatory, hateful, harassing, obscene, exploitative or child-harming content.
  • Uploading material without required rights, permissions or lawful basis.
  • Scraping, bulk extraction, unauthorised collection of personal data, spam or misuse of messaging.
  • Attempts to bypass security, moderation, access controls, rate limits or verification processes.

14. Search, Ranking and Visibility

Visibility may depend on relevance to the user's search and filters, location/distance where applicable, selected sorting method, completeness and usefulness of listing information, active published activities, claim/verification status, recency and limited editorial selection.

Kiddonido does not currently sell paid ranking advantage. If paid or promoted placement is introduced, applicable disclosures and these Terms will be updated before it applies.

Kiddonido does not disclose exact ranking weights or anti-manipulation mechanisms.

15. Moderation, Reports, Suspension and Removal

Kiddonido may review, format, decline, hide, unpublish or remove content or listings, remove a verification status, and restrict, suspend or close an account where it reasonably believes these Terms have been breached, information is materially inaccurate, content may be unlawful or unsafe, evidence has expired, a credible safeguarding concern exists, or action is required by law.

Users and Providers may report potentially unlawful content, unauthorised images, misleading listings or child-safety concerns through the contact page. Subject to applicable law, Kiddonido will provide relevant reasons for restrictions and an appropriate route to request review through the contact page. Urgent risks to a child should also be reported to the appropriate public authorities.

16. Existing and Unclaimed Listings

Kiddonido may create an unclaimed listing using publicly available information or its own editorial research. Such publication does not imply endorsement, partnership or affiliation. An eligible business may request correction, claim the listing subject to verification, or request removal where appropriate.

17. Third-Party Services and Sources

Kiddonido may link to or integrate third-party websites, maps, messaging tools and business-information services. Those services operate under their own terms and privacy policies. Third-party links or data do not constitute endorsement.

18. Kiddonido Intellectual Property

The Kiddonido name, logo, platform design, software, editorial content and compilation/arrangement of platform content are owned by Kiddonido or its licensors. Except as permitted by law or expressly authorised, Providers may not reproduce, republish or systematically extract substantial parts of the platform.

19. Platform Availability and Changes

Kiddonido aims to provide a reliable service but does not guarantee uninterrupted or error-free access. Features may be changed, added or withdrawn. If booking, payment, subscription, advertising or other materially different commercial functionality is introduced, the applicable terms will be updated before that functionality applies.

20. Liability and Independent Provider Status

Providers are independent businesses and are not employees, agents, partners or representatives of Kiddonido. The Provider is responsible for the delivery, quality, safety, legality and suitability of its activities and for its own representations and arrangements with users.

To the extent permitted by law, Kiddonido is not responsible for losses arising from Provider-supplied information or from the Provider's delivery of an activity or service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

21. Changes to Provider Terms

Each version will show an effective date. Material changes affecting Providers will be communicated with the advance notice required by applicable law, including any applicable notice requirements governing online intermediation services, unless a lawful exception permits shorter notice. Where applicable law requires fresh express agreement, continued use alone will not be treated as sufficient acceptance.

22. Ending the Provider Relationship

The Provider may stop using Kiddonido and request closure of its account or unpublication of its managed listing, subject to lawful retention requirements. Kiddonido may suspend or terminate access as described above.

Where applicable, Kiddonido will explain whether and for how long Provider data remains accessible after termination. Provisions that by their nature should survive termination, including intellectual property, liability, evidence of acceptance and governing law, continue to apply.

23. Privacy

Kiddonido's processing of personal data is described in its Privacy Notice. Cookie and similar-technology information is described in its Cookie Notice. These documents should be made available separately and linked from the Provider registration flow.

24. Governing Law and Disputes

These Terms are governed by Spanish law, subject to any mandatory rules that apply. The competent courts will be determined in accordance with applicable law. Providers should contact Kiddonido first through the contact page so that issues can be reviewed informally where appropriate.

25. Electronic Acceptance and Record of Agreement

The Provider must be given access to these Terms before acceptance in a form that can be stored and reproduced. Acceptance should be made through a separate unticked checkbox or equivalent affirmative action.

Kiddonido should retain an appropriate acceptance record including the Provider/business, accepting person's name and role, account or verified email, Terms version, date/time and acceptance action. Optional marketing consent must be separate.

Suggested checkbox wording: “I confirm that I am authorised to act for this Provider and I have read and agree to the Kiddonido Provider Terms & Conditions.”
